Understanding the Residential Tenancy Act
BC's Residential Tenancy Act
The Residential Tenancy Act (RTA) governs most residential tenancies in British Columbia. The Residential Tenancy Branch (RTB) administers this act and provides dispute resolution services.
Security Deposits
- Maximum security deposit is half of one month's rent
- Landlord can also collect a pet damage deposit (additional half month)
- Deposits must be returned with interest within 15 days of tenancy ending
- Move-in and move-out condition inspections are required
Rent Increases
Landlords can increase rent once a year by the maximum allowable amount set by the province (typically inflation + 2%). Three months written notice is required on the approved form.
Ending a Tenancy
Tenants on a month-to-month tenancy must give one full month's notice. Landlords have more limited reasons they can end a tenancy and must provide two months notice in most cases.
Note
Landlords ending a tenancy for their own use must pay the tenant one month's rent as compensation. If they don't move in, the tenant may be entitled to additional compensation.
