Tenant Rights in Quebec
Guide to the Régie du logement and Civil Code
Quebec's Rental Laws
Quebec has strong tenant protections under the Civil Code and the Tribunal administratif du logement (TAL, formerly Régie du logement). These laws apply to most residential leases.
The Mandatory Lease
Quebec requires the use of a mandatory lease form for most residential rentals. This standardized document ensures tenants receive all required information about their rights.
Lease Transfer (Cession de bail)
Quebec allows tenants to transfer their lease to another person. The landlord can only refuse for serious reasons. This is different from subletting - the original tenant leaves permanently.
Pro Tip
Lease transfers are a great way to help friends find apartments in tight rental markets. The new tenant takes over your exact lease terms, including rent amount.
Rent Increases
Landlords can propose rent increases annually. Tenants have the right to refuse and have the TAL determine if the increase is justified. The TAL publishes annual guidelines for calculating reasonable increases.
Lease Renewal
In Quebec, leases automatically renew unless proper notice is given. Tenants have strong renewal rights and cannot be evicted simply because the lease term ended.
